1. Introduction

Welcome to Au Chin English Coaching ("we," "our," or "us").

These Terms and Conditions ("Terms") govern your use of our English tutoring services (the "Service"). By booking a lesson or purchasing a package, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree with any part of these Terms, you may not use our Service.

 
2. Definitions

"Student" or "You" refers to the individual purchasing and receiving tutoring services.

"Service" refers to English tutoring lessons, including one-on-one coaching, group sessions, and all related educational materials provided by Au Chin English Coaching.

"Package" refers to a pre-purchased bundle of lesson hours (Monthly, Obsessed, or Committed).

"Lesson" refers to a scheduled tutoring session, typically conducted via Zoom.

 
3. Service Description

 

Au Chin English Coaching provides personalized English tutoring services for advanced learners (B2+ level). We offer:

  • Individual coaching sessions ("I Want It I Got It," "Keep It Real," "Best of Both Worlds")

  • Group lessons ("Just The Four Of Us")

  • Customized lesson materials and progress tracking

All services are provided remotely via video conferencing platforms (primarily Zoom) and learning platforms (Edvibe).

 
4. Eligibility

 

Our services are designed for:

  • Adults (18 years and older)

  • Advanced English learners (B2 level or higher)

We reserve the right to assess your English level during a free consultation and may decline service if we determine we are not a good match for your needs.

 
5. Booking and Scheduling
5.1 Consultation

All new students must complete a free 30-minute consultation before purchasing a package. This allows us to assess compatibility and discuss your goals.

5.2 Scheduling Lessons
  • Lessons are scheduled by mutual agreement between student and instructor

  • Students are expected to attend lessons at agreed-upon times

  • Schedule changes must be requested in accordance with our cancellation policy (Section 7)

5.3 Lesson Duration
  • Standard lesson duration is 1.5 hours (90 minutes) unless otherwise agreed

  • Trial sessions are 1.5 hours (90 minutes)

 
6. Payment Terms
6.1 Payment Methods

We accept payment via:

  • PayPal (USD)

  • Tinkoff (Rubles)

  • Binance (USDT, USD)

6.2 Payment Schedule
  • Payment is required in full before the first lesson of each package

  • Trial sessions must be paid before the trial lesson

  • No lessons will be conducted until payment is confirmed

6.3 Currency and Fees
  • Primary currency: USD

  • Students are responsible for any transaction fees, currency conversion fees, or payment processing charges

  • Prices are subject to change with 30 days' notice to existing students

6.4 Failed Payments

If a payment fails or is reversed:

  • Lessons will be suspended until payment is resolved

  • We reserve the right to cancel remaining lessons in the package

  • Student remains responsible for payment of services already rendered

 
7. Cancellation and Rescheduling Policy
 
7.1 Student Cancellations
  • 24+ Hours Notice: Free cancellation/rescheduling (subject to availability and package limits)

  • Less than 24 Hours Notice: Lesson is deducted from your package

  • No-Show: Lesson is forfeited and deducted from your package

Free Cancellations with 24+ hours notice by Package:

  • Monthly Pack: 1 free cancellation

  • Obsessed Pack: 3 free cancellations

  • Committed Pack: 6 free cancellations 

7.2 Emergency Situations

Emergency situations (sudden illness, family emergencies, etc.) are handled on a case-by-case basis. We understand that life happens. Contact us as soon as possible to discuss options.

7.3 Late Arrivals
  • If you arrive late, the lesson will still end at the originally scheduled time unless otherwise agreed

  • Arrivals 15+ minutes late without prior notice may be considered a no-show, subject to instructor discretion

  • Lessons will not be extended to compensate for late arrivals

7.4 Instructor Cancellations

If we need to cancel a lesson:

  • We will provide at least 24 hours' notice when possible

  • We will reschedule the lesson at no additional charge

  • For same-day cancellations due to emergency, we will offer a makeup session

7.5 Instructor Lateness or No-Show

If we are late or fail to appear:

  • We will extend the lesson to provide the full scheduled time, or

  • We will add a free makeup lesson to your package hours

 
8. Lesson Freeze Policy
 
8.1 Freeze Terms

Students may freeze lessons under the following conditions:

  • Maximum of 1 month total freeze per calendar year

  • Minimum freeze period: 1 week (typically 2 lessons)

  • Requires 1 week advance notice

  • Freezes can be used as one continuous month or broken into smaller periods (minimum 1 week each)

8.2 Package Extension

Package expiration dates automatically extend by the total freeze time used.

8.3 Emergency Freezes

For medical emergencies or sudden family situations, freezes can be granted immediately without advance notice at the instructor's discretion.

 
9. Package Expiration
 
9.1 Validity Periods
  • Monthly Pack: Valid for 6 weeks from purchase date

  • Obsessed Pack: Valid for 3 months from purchase date

  • Committed Pack: Valid for 6 months from purchase date

9.2 Expired Hours
  • Unused hours expire at the end of the validity period

  • Expired hours are non-transferable and non-refundable

  • Extensions may be granted only for documented medical emergencies or extended freezes

 
10. Refund Policy
 
10.1 General Refund Terms

We value happy, satisfied students. Refunds are available for unused lesson hours only under the following circumstances:

Immediate Refund Eligibility:

  • Unsatisfied with lessons after initial sessions

  • Mutual agreement that we are not a good match

  • Disputes or conflicts regarding service delivery

  • Medical emergencies preventing continuation (documentation may be requested)

  • Instructor's inability to deliver promised services

10.2 Refund Conditions
  • Notice Requirement: For non-emergency refunds, provide at least 1 week advance notice

  • Partial Refunds Only: Only unused lesson hours will be refunded

  • Used Hours: Any completed lessons will be deducted from the refund at the package rate

  • Processing Time: Refunds processed within 14 business days

10.3 Non-Refundable Situations
  • Lessons already completed

  • Cancellations with less than 1 week notice (unless emergency)

  • Termination due to student misconduct (see Section 12)

  • Packages purchased more than 6 months ago

11. Student Responsibilities
11.1 Attendance and Participation

You agree to:

  • Attend scheduled lessons on time

  • Come prepared and ready to engage

  • Complete homework assignments when applicable

  • Communicate scheduling conflicts promptly

11.2 Technical Requirements

You are responsible for:

  • Stable internet connection

  • Functioning computer/device with camera and microphone

  • Zoom access (free account acceptable)

  • Quiet environment conducive to learning

11.3 Honesty and Communication

You agree to:

  • Provide accurate information about your English level

  • Communicate learning goals and challenges openly

  • Notify us promptly of any issues or concerns

 
12. Code of Conduct
 
12.1 Expected Behavior

Students are expected to:

  • Treat the instructor with respect and professionalism

  • Maintain appropriate language and behavior during sessions

  • Respect the instructor's time and expertise

12.2 Prohibited Behavior

The following behaviors are strictly prohibited:

  • Harassment, bullying, or intimidation

  • Appearing intoxicated or under the influence during lessons

  • Recording lessons without explicit consent

  • Sharing or reselling course materials

12.3 Termination for Misconduct

We reserve the right to immediately terminate service for:

  • Violation of the Code of Conduct

  • Repeated disrespect or inappropriate behavior

  • Harassment of any kind

  • Fraudulent payment or chargebacks

No refund will be issued for termination due to student misconduct.

 
13. Intellectual Property Rights
 
13.1 Ownership of Materials

All lesson materials, vocabulary lists, exercises, notes, and content created by Au Chin English Coaching remain our intellectual property.

13.2 Student Usage Rights

You may:

  • Use materials for your personal learning

  • Reference materials for your own study

  • Keep copies of shared documents for personal use

13.3 Prohibited Uses

You may NOT:

  • Share, distribute, or resell our materials

  • Use materials for commercial purposes

  • Claim ownership of our content

  • Reproduce materials for other students or learners

13.4 Lesson Recordings
  • Recording lessons requires explicit written consent from the instructor

  • Unauthorized recording is strictly prohibited

  • Approved recordings are for personal use only

 
14. Content Usage and Consent
 
14.1 Testimonials and Feedback

With your explicit written consent, we may:

  • Share text testimonials on our website and social media

  • Use your first name or initials (full name only with additional permission)

  • Include feedback in promotional materials

14.2 Lesson Content Sharing

With your explicit written consent, we may:

  • Record lesson clips for educational purposes

  • Share anonymized lesson excerpts on social media

  • Use lesson materials for instructor training

14.3 Your Rights
  • Consent is always optional and does not affect service quality

  • You may withdraw consent at any time

  • You may request removal of previously shared content

  • You have the right to review and approve content before public sharing

 
15. Limitation of Liability
 
15.1 Service Nature

Au Chin provides English language coaching and educational services. We do NOT guarantee:

  • Specific outcomes (job offers, promotions, test scores)

  • Citizenship or visa approvals

  • Academic admission or success

  • Business opportunities or contracts

15.2 Student Responsibility

Your success depends on:

  • Your effort, practice, and dedication

  • External factors beyond our control

  • Your application of learned skills

  • Opportunities and circumstances in your life

15.3 No Liability for Outcomes

We are not liable for:

  • Failed job interviews, applications, or exams

  • Immigration or citizenship denials

  • Academic or professional setbacks

  • Financial losses related to language proficiency

  • Third-party decisions or evaluations

15.4 Maximum Liability

Our total liability for any claim related to our Service shall not exceed the amount you paid for your current package.

 
16. Privacy and Data Protection

 

Your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you also agree to our Privacy Policy.

  • We collect minimal personal data necessary for service delivery

  • We do not sell or share your information with third parties (except service providers)

  • You have rights to access, correct, and delete your data

17. Third-Party Services
 
17.1 External Platforms

Our Service relies on third-party platforms including:

  • Zoom (video conferencing)

  • Edvibe (learning platform)

  • PayPal, Tinkoff, Binance (payment processing)

17.2 Third-Party Terms

Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for third-party platform failures, changes, or policies.

17.3 Platform Disruptions

We are not liable for service disruptions caused by third-party platform outages or technical issues. We will make reasonable efforts to reschedule affected lessons.

 
18. Dispute Resolution
 
18.1 Good Faith Communication

We believe in resolving issues through open, honest communication. If you have concerns:

  1. Contact us directly via email, Instagram, Telegram, or WhatsApp

  2. Clearly explain your concern or complaint

  3. We will respond within 48 hours

  4. We will work together to find a mutually acceptable solution

18.2 Mediation

If direct communication does not resolve the issue, both parties agree to attempt mediation before pursuing legal action.

18.3 Governing Law

These Terms are governed by the laws of Vietnam, where our business is based.

 
19. Changes to Terms and Conditions
 
19.1 Right to Modify

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website with a revised "Last Updated" date.

19.2 Notification of Changes

For material changes, we will notify current students via:

  • Text message

  • Prominent website notice

  • Notice during scheduled lessons

19.3 Acceptance of Changes

Continued use of our Service after changes constitutes acceptance of the updated Terms. If you do not agree with the modified Terms, you may request a refund for unused lessons within 7 days of notification.

 
20. Severability

 

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

 
21. Entire Agreement

 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Au Chin English Coaching regarding the use of our Service, superseding any prior agreements.

These Terms and Conditions are designed to create a fair, transparent, and mutually respectful relationship between Au Chin and our students. We are committed to providing exceptional service while maintaining clear expectations and policies.
